These General Terms of Service ("General Terms") govern the performance services provided by
King Performance Ideology Limited ("KPI", "we", "us") to the athletes we work with
("you"). They form part of, and are incorporated by reference into, each signed Service Agreement between KPI and an athlete. Where a Service Agreement and these General Terms conflict, the Service Agreement takes precedence for the matters it addresses.

1. Definitions
- Service Agreement - the individual agreement signed by you and KPI that sets out your
selected deliverables, fees and commercial terms. - Framework - the Athlete Performance Framework across the Discovery, Support and Coaching
pillars, from which your deliverables are drawn. - Services - the performance support KPI provides to you under your Service Agreement.
- Materials - the programmes, assessments, reports, plans, methods, content and tools KPI
provides or makes available, including through the KPI App.
2. The Services
KPI provides individualised, science-led sports performance support aimed at helping you train smarter, recover well, and sustain long-term performance. The Services are delivered through the Athlete Performance Centre, remotely, and through the KPI App, as set out in your Service Agreement. KPI will deliver the Services with reasonable skill and care and in line with professional standards.
3. Responsibilities
- KPI will deliver an evidence-informed, individualised and professional service centred
on your best interests, and communicate openly throughout the programme. - You will engage actively with the agreed programme, attend agreed sessions, follow
reasonable guidance, and communicate openly and honestly - including disclosing relevant medical, injury and health information (see Section 4). The quality of your outcomes depends in part on your engagement.
4. Health, Safety and Medical Disclaimer
- The Services support your physical development and are designed to reduce the risk of
injury and support performance. They do not guarantee any particular outcome, result, or
freedom from injury. - The Services are not a substitute for medical advice, diagnosis or treatment. Where the Services include input described as physiotherapy, this is provided only by appropriately qualified and, where relevant, HCPC-registered practitioners. Nothing in the Services should be taken as clinical medical advice unless expressly provided as such by a registered clinician.
- You must disclose any medical condition, injury, symptom or medication that may affect your safe participation, and keep us updated. You should seek advice from a qualified medical professional before starting any new training programme where appropriate.
- You take part in physical training and assessment voluntarily and accept the inherent risks
of physical activity, subject to KPI's duty to deliver the Services with reasonable skill
and care.
5. Fees and Payment
- Fees, their basis, and the cancellation and notice terms specific to your Services are set
out in your Service Agreement. - All fees are exclusive of VAT, which is charged at the prevailing rate.
- Recurring fees are collected by Direct Debit. You will be asked to authorise a Direct
Debit mandate through our payment provider before any collection is taken. Your authorisation is protected by the Direct Debit Guarantee, and we will give you advance
notice of the amount and date of each collection, and of any change to either. The
collection date we notify to you is the due date for that fee. - One-off services are invoiced, and may be paid by bank transfer or online by debit or
credit card. An invoice is payable within 15 days of its date, or before the service it
relates to is delivered, whichever is earlier - unless your Service Agreement says
otherwise or we agree otherwise in writing. - We may suspend the Services where fees remain unpaid after their due date, and will tell
you before we do. - We may change our fees on notice, as set out in your Service Agreement.
6. Intellectual Property
- All Materials, and all intellectual property rights in them, remain the property of KPI (or
its licensors). This includes the Framework, assessment methods, programmes, reports, and KPI App content. - KPI grants you a personal, non-transferable, non-exclusive licence to use the Materials for
your own training and development for the duration of your Service Agreement. You may not copy, resell, share, publish or otherwise make the Materials available to any third party
without our prior written consent. - Data and results generated about you belong to you; KPI may hold and use them to deliver
and improve the Services, in line with Section 8.
7. Confidentiality
Each party will keep confidential the non-public information it receives from the other and use it only to perform or receive the Services. KPI will treat your personal, medical and performance information as confidential. You will keep KPI's methods, Materials and pricing confidential. This does not apply to information that is or becomes public through no breach, or that must be disclosed by law.
8. Data Protection
KPI processes personal data - including health and performance data - in line with UK data protection law (the UK GDPR and the Data Protection Act 2018). We act as controller of the personal data we process to deliver the Services. Health and performance data is special category data and is handled with additional care and on an appropriate lawful basis. 9. Marketing and Publicity
KPI will not use your name, image or likeness in marketing, case studies or promotional material without your prior express consent, which you may withdraw at any time in respect of future use.
10. Limitation of Liability
- Nothing in these General Terms or a Service Agreement limits or excludes either party's
liability for death or personal injury caused by negligence, for fraud, or for anything
else that cannot be limited or excluded by law. - Subject to the above, KPI shall not be liable for any indirect, incidental, consequential or
punitive loss arising out of or related to the Services. - Subject to the above, KPI's total liability arising out of or in connection with the Services shall not exceed the total fees paid by you under your Service Agreement in the
12 months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless KPI and its officers, directors, employees and agents from and against claims, liabilities, losses, costs and expenses arising out of your breach of these General Terms or your Service Agreement, or your misuse of the Services, save to the extent caused by KPI's own negligence or breach.
12. Changes to These Terms
KPI may update these General Terms from time to time. Where a change materially affects your rights, we will give you reasonable notice. Your continued use of the Services after a change takes effect constitutes acceptance of the updated General Terms.
13. Governing Law
These General Terms and each Service Agreement are governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
14. Severance
If any provision or part-provision of these General Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision under this clause shall not affect the validity and enforceability of the rest of these General Terms. The parties shall negotiate in good faith to amend any such provision so that, to the greatest extent possible, it achieves the intended commercial result.
15. Acceptance
By signing a Service Agreement, you confirm you have read and accept these General Terms. If you do not agree with any part of them, you must not use the Services.
